Earlier this semester, SIPA News spoke with Yasmina Dardari MIA ’17 to discuss how she manages the demands of school, her social life, and her internship at Unbendable Media. What did you do before coming to SIPA? I worked in D.C. for a few years at public-interest communications firm that did work for nonprofits and governments. I decided to attend SIPA to dig deeper into my own interests in media and human rights and also explore some of the the policy issues my clients were working on. I’m really into media, politics, public relations, strategic campaigning, and human rights. My specialization in Technology, Media, and Communications and my concentration in Human Rights and Humanitarian Policy allows me to combine all of these interests. What do you do at Unbendable Media? Unbendable Media is a team of communications practitioners that do campaign strategy and public relations work for organizations that aim to build a better, more progressive world. A former colleague started the company and and reached out to me to join his team. I do much of the same work I did with the firm in D.C.â€"providing campaign strategy and public relations works for organizations working for the public interest. Having this particular part-time job has really informed my SIPA education. My clients work on the same policy problems that we work on at SIPA, so my work informs school and school informs my work. It’s like a two-way symbiotic relationship that makes me a better employee and student. Why Unbendable Media? I wanted to keep myself sharp in the field that I care about, so I started interning at the organization last summer. They liked my work and asked me to stay on as a part-time worker. I enjoy the work, so it was a no-brainer to accept the offer. It will allow me to work in media and politics, which is where my heart is. How do you balance your school and work commitments? It’s not easy. It’s give and take. Ideally I wouldn’t have to work while attending school, but financially I can’t afford not to. I didn’t work my first semester, which allowed me to throw myself into my studies. I was able to go to lectures and fully dedicate myself to schoolwork. It became difficult after that because I was the co-president for the Middle East Dialogue Group and had an assistantship in addition to my part-time work at Unbendable Media. Sometimes I feel like I’m missing out on the full SIPA experience. My schedule is exhausting but it’s taught me the value of self-care. I know now how important it is to keep my stamina up, so I’m smarter about taking breaks and making efforts to spend time on my hobbies and see friends. Also, my time management skills have improved so much because of this experience. I make sure I’m on track and hit my benchmarks. My life would be a lot less stressful [if I didn’t work outside SIPA], but you can make it work if you have structure. The First Amendment And Equal Protecting - Free Essay Example

The first amendment states that Congress shall make no â€Å"law respecting an establishment of religion or prohibiting the free exercise thereof (Lemon v. Kurtzman). This section of the first amendment refers to the establishment clause and free exercise clause and in other words this prevented the government from investing any of its resources to a particular belief system, or prevent anyone from practicing their own belief system, creating a separation of church and state. When it comes to education states have to fund their public schools mostly with taxes, but what about non-public and non-secular schools? â€Å"The Pennsylvania Nonpublic Elementary and Secondary Education Act was passed in 1968 in response to a crisis that the Pennsylvania Legislature found existed in the States nonpublic schools due to rapidly rising costs. The statute affirmatively reflects the legislative conclusion that the States educational goals could appropriately be fulfilled by government support of ‘those purely secular educational objectives achieved through nonpublic education† (Lemon v. Kurtzman). Pennsylvania adopted statutes that provided the state the ability to fund the salaries of teachers, textbooks, and instructional material for secular educational services to non-secular and non-public elementary and secondary schools at the expense of taxpayers. Alton Lemon was the lead plaintiff on the case. Appellant Lemon, in addition to being a citizen and a taxpayer, is a parent of a child attending a public school in Pennsylvania. Funds for this Act came from taxes on horse and harness racing and cigarettes. â€Å"Lemon also alleges that he purchased a ticket at a racetrack and thus had paid the specific tax that supports the expenditures under the Act. Appellees are state officials who have the responsibility for administering the Act† (Lemon v. Kurtzman). Lemon had a standing in this case as a tax-paying citizen of Pennsylvania, as a parent of a child that attended a Pennsylvania public school, and specifically for the taxes collected from the sales of a racetrack ticket he purchased. All these actions directly infringed on his first amendment right, because the money collected from these associated taxes went to Catholic schools since they made up a majority of the states private schools, and this is money that could have wen t to public schools and supported a religion he did not believe in. â€Å"A school seeking reimbursement must maintain prescribed accounting procedures that identify the ‘separate’ cost of the ‘secular educational service.’ These accounts are subject to state audit† (Lemon v. Kurtzman). This is an example of the government’s involvement with non-secular non-public schools and how they have entangled themselves and are now respecting the establishment of religion since, they are directly funding, and now auditing them to ensure public money allocated to the schools are going to secular education programs only, both unconstitutional under the Establishment and Exercise Clause. The case was initially brought before a Pennsylvania District Court where three federal judges thought, â€Å"the individual plaintiffs-appellants had a standing under Flast v Cohen (1968). The court granted appellees motion to dismiss the complaint for failure to state a claim for relief. It held that the Act violated neither the Establis hment nor the Free Exercise Clause, Chief Judge Hastie dissenting. We reverse. â€Å"(Lemon v. Kurtzman). In 1971 Supreme Court ruled that public funds from taxes to pay for non-secular schools violated the establishment clause of the first amendment in the United States Constitution. This ruling resulted in the creation of the Lemon Test, which is a three-part evaluation of any legislation related to religion. Sponsorship, financial support, and active involvement were the focal points of the provision. The court held that the law must pass a tripartite test to avoid violating the establishment clause. The statute must also have a secular legislative purpose, and its primary focus must be to neither promote or prevents religion and should not endorse government entanglement with religion. â€Å"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury† (US v. Calandra). This first part of the Fifth Amendment is designed to protect all persons from the government against the unlawful persecution of a crime without due process. A grand jury is a panel of twelve to twenty-three citizens deciding whether or not there is enough evidence against the accused by a prosecutor to grant an indictment and bring charges against the person. This is one of the five main provisions found under the Fifth Amendment; the Fourteenth Amendment helps apply it to the states. The sixth amendment â€Å"guarantees the right to an impartial jury† (Apprendi v New Jersey). In other words all persons have the right to a fair trial and protection from jurors with biases. An impartial jury are judges whose actions and decisions are free of bias or prejudice, all people regardless of race, nationality, sex, religion, or economic status, have the right to a trial by a fair and impartial jury. Both a grand jury and impartial jury are similar and different in many ways, but also compliment each other. â€Å"On December 11, 1970, federal agents obtained a warrant authorizing a search of respondent John Calandras place of business, the Royal Machine Tool Co. in Cleveland, Ohio. The warrant was issued in connection with an extensive investigation of suspected illegal gambling operations† (US v. Calandra). No evidence of illegal gambling was found but evidence of loan sharking was. In this case the prosecutions presents this evidence illegally obtained through the search of Calandra’s business to a grand jury where he is indicted. This should have been protected under the Fourth Amendments Exclusionary Rule since this was an unlawful search and seizure, and the prosecution knows this. â€Å"Exclusionary rule of Fourth Amendment, under which evidence obtained from prior unlawful search and seizure is excluded in trial of criminal prosecution† (US v. Calandra). So even though the trial jury will never hear or see this evidence, it is used on the grand jury to bring an indictment, which is very hypocritical and in some ways very bias. When questioned about his activities John P. Calandra refused to answer, stating that the search violated his Fourth Amendment right. Supreme court ruled that the exclusionary rule could not apply to grand jury proceedings because their purpose is to find out whether a crime had been committed and formally charge someone with said crime, and deter misconduct by those trusted to investigate the crime, and the exclusionary rule interferes with that. â€Å"Apprendi fired several shots into the home of an African-American family and made a statement-which he later retracted-that he did not want the family in his neighborhood because of their race† (Apprendi v. New Jersey). He was charged under New Jersey’s law with inter alia, second-degree possession of a firearm for an unlawful purpose that carries a prison term of 5 to 10 years and due to a plea deal with the prosecutor was never charged with a hate crime, but the penal code does have hate crime provisions written within the criminal code allowing a trial judge to impose an enhanced sentence, if evidence of a racial bias is presented. During Apprendi’s trial testimony from the officer was presented in court. â€Å"The judge, however, found the police officers testimony credible, and concluded that the evidence supported a finding that the crime was motivated by racial bias† (Apprendi v. New Jersey). As a result Apprendi was sentenced to 12 year of im prisonment 2 years over the original maximum, but since he is now being charged with an additional offense the punishment was within range of the statute. Supreme court ruled this was unconstitutional because under the Due Process Clause any penalty beyond the maximum prescribed must be submitted to a jury and proven beyond a reasonable doubt. Here evidence presented is being marked as insufficient because it was not formally brought up as a charge by a grand jury. This is complimentary to what is seen in the Fifth Amendments provision, because a grand jury is presented with evidence too indict. These actions by the trial judge in this case created a contradiction in the law the way he sentenced Apprendi. Without a grand jury’s approval he cannot just increase the sentence this is part of common law In US v Calandra we see that the grand jury is being presented with evidence to aide the prosecution in bringing an indictment, but in Apprendi v. New Jersey the prosecution withheld evidence to aide the suspect as part of a plea deal. This is why the there is a lot of criticism surrounding grand juries as they have been labeled a â €˜rubber stamp’ for the prosecution and have little to no independent function to protect people from the government. Edith Windsor is a taxpayer who, as surviving spouse of a same- sex couple, was denied benefit of spousal deduction due to definition of â€Å"marriage† and â€Å"spouse† provided by Defense of Marriage Act DOMA. She brought action for a refund of federal estate taxes and for declaration that the provision of DOMA violated her Fifth Amendment right. Windsor is the widow of Thea Clara Spyer, who died in 2009. They were married in Toronto, Canada, in 2007, and their marriage was recognized by the state of New York. When she died Spyer left her property to her spouse, and because federal law did not recognize their marriage, the government imposed $363,000 in taxes. If their marriage was recognized, the estate will be eligible for an exemption from marriage, and no taxes will be imposed. In US v. Windsor the inhertance of an estate disproves polygamy because the division of assetts amongst two spouses would result in a dispute. The proceedings would draw out in a court matter requiring government entanglement in marriage, which could be argued to not separate church and state. â€Å"n 1996, as some States were beginning to consider the concept of same-sex marriage, see, e.g., Baehr v. Lewin, 74 Haw. 530, 852 P.2d 44 (1993), and before any State had acted to permit it, Congress enacted the Defense of Marriage Act (DOMA), 110 Stat. 2419. DOMA contains two operative sections: Section 2, which has not been challenged here, allows States to refuse to recognize same- sex marriages performed under the laws of other States† (US v. Windsor). Even though New York State accepted her marriage federally it was still not recognized at the time, or by o ther states that did not acknowledge same-sex couples. As a result there is little to no regard for polygamy, which is far more extreme that same-sex marriage. In Lawrence v. Texas for polygamy is also not going to be protected as seen in the â€Å"Texas statute making it a crime for two persons of the same sex to engage in certain intimate sexual conduct was unconstitutional, as applied to adult males who had engaged in consensual act of sodomy in privacy of home, as impinging on their exercise of liberty interests protected by the Due Process Clause of the Fourteenth Amendment† (Lawrence v. Texas). Supreme court ruled that the criminal complaintants rights were violated under the Due Process Clause of he Fourteenth Amendment, because two consensual adults conducting in sexual activity in the home is considered privacy protected. Even though this protects the right to practice sexual activites deemed ‘different’ in the privacy of ones own home. A marriage is a legally recognized union between two people established by law, and applied throughout the nation in many provisions. Current United States law does allow or reco gnize polygamy and many statutes and provisions established beforehand support this current state. Even though what you do in your home constitutes as your privacy once apart of society there are laws to follow and guidelines to abide by and as far as marriage constitutes in the United States polygamy does not fit under those provisions. Whether polygamy be morally wrong or a constitutional right is not federally protected, and it is up to future courts to decide if the case should ever come up. As seen in states like Utah where polygamy is heavily practiced. Statutes establishing an anti-polygamy agenda have been declared unconstitutional, yet the ban on multiple marriage licenses stays intact. The 14th Amendment Fourteenth Amendment to the United States Constitution was adopted on 9 July 1868 as one of the reconstruction amendments. One of the most important amendments to this day is that the because it deals with citizenship rights and equal protection of laws, and has been proposed in response to issues relating to former slaves following the American Civil War. This amendment is a crucial one, because states had to ratify it in order to restore representation in Congress. This especially hurt the Confederate Southern states who lost the war. This amendment is crucial in providing equal protecting under the law to the entire nation, and as a result help to unify the states under a federal legislative branch, but also garaunteed rights to those formally unrecognized under statehood. The provisons also took the current laws and applied them to states that failed to follow federal guidelines and brought about change and opportunity that many people once could not afford. The Due Procees clause granted protection from the federal government but now also applied it to states that were rebelling and abusing its citizens. For example in Brown v. Board of Education where courts stated that â€Å"separate is inherently unequal† and ruled that public school segregaton violated the Fourteenth Amendment’s equal protection clause, gave opportunites to African Americans that did not have them attending segrated schools, opening doors and giving people a chance to reach the American dream. For instance, you may find people who share the modernized way of dressing choosing to live together in a village and work amongst themselves. A good example can be found in China, where those who have a traditional background choose not to interact with those who have a modern way of dressing. Determining of the Management Style The culture goes a long way in determining the mode and style of management to be employed in the workforce. Secondly, in negotiations, the Chinese people choose not to talk first in tabling down their arguments, unlike the Americans who will always talk first. When it comes to the American style of management, they have a mode where the duties are divided amongst the executives. Hence each executive can give orders. Economic Comparison In the economic comparison America and China rank top in the World. The U.S is the leading trader in the World when it comes to exports and imports while China closely follows it. U.S also boasts of the largest GDP in the World. It is not clear whether Germany or China comes second regarding GDP since their GDP is almost similar. As for me, I will conclude that China boasts of the second largest GDP in the World after the US. Lets consider two base years in our GDP comparison that is 2015 and 2016. In 2016 the GDP of the US was 57436, while in the previous year the GDP was 56175. This represents a growth of about 8% in the GDP. Secondly, in China, the GDP in 2015 was 55218 while in the following year the GDP was 56857. Also, this represents a growth of about 8.5%. This means that the economy of China is growing at a higher rate compared to that of US. Unemployment In 2015, the unemployment in the US was 5.30% while in 2016 the unemployment rates reduced to 4.90%. This means that the economy of US was growing thus creating more employment opportunities in the economy. In 2015 the unemployment in China was 4.5%. In the following year that is 2016, the unemployment rate drastically reduced to 3.96%. This paints a picture where the economy of China is performing better compared to the economy of US. On the contrary, the economy of US is ranked among the best in the World ahead of that of China (Hiroshi 2016). Exports and Imports In 2015, the US exported 0.10 % while it imported 4.60%. This means that the US imported more than it exported. In the following year imported 1.10% while it exported 0.40%. Also, this is in line with the previous year where the country exported more than it imported. Comparing this to the Chinese economy, in 2015 the country exported 5.40% while it imported 3.28%. This shows that the country exports more than it imports. In 2016, China exported 5.21% and imported 4.67%. This show that in 2016 China imported more than it exported. This might be one of the reasons why the economy of US is said to be performing better compared to that of China due to its stability (World Bank 2017). Levels of Public Debt The US is one of the top lenders in the World. China is also a top lender in the World. Most of their landings are given to developing countries of the World. Though these countries can fully fund their national budgets, they must borrow from the citizens and other financial institutions, eg, the World Bank. This is with an aim to keep their economies afloat even at hard times and to maintain the economy at equilibrium in times of recession or economic booms. In 2015, the US had a public debt of about 105% while in 2016 this amount rose to 108%. This shows that the U.S government is borrowing more and more. Comparing this to the government of China, in 2015 the country had a public debt of approximately 110%. In the year 2016, this amount rose to about 115%. This means that the government of China owes more debts to its citizens and international financial institutions compared to U.S. Factoring in the level of debt this might be another reason to show why the economy of U.S is performing better compared to that of China. Finally, in terms of the economy, the services sector contributes the highest percentage towards the GDP of the countries. In China, the industries sector contributes a higher percentage to the GDP compared to the US. In the agricultural sector, the contribution in the US is greater than that in China. However, the wideness of the services sector in the US makes its economy perform better than China (W.TO 2017). Population of the US U.S is one of the most populous countries in the World. This is the case since most of the country is urbanized. This means that the greatest percentage of the population lives in urban areas. There is little or no population at all living in the US rural areas. This is why the U.S largely depends on imports for most of its food supplies since there are no farmers in the rural areas to cultivate the fields. In the past four years, the population of the US has been on an upward trend. In 2013 the population was 317 million. In the following year 2014, the population grew to 319 million. In 2015 the population further grew to 321 million, and finally, in 2016 it reached its peak of 323 million inhabitants. In the US the growth has been attributed mainly to increasing rate of teenage pregnancies. Another factor which has led to the growth in population is the fact that the number of immigrants who are acquiring American citizenship is on the increase. In China, the population is 1. 4 billion approximately. This is the largest population in any country of the World. Compared to the US, the population of China has stagnated over the past few years. The estimated growth rate is 0.58% per year. This means that some countries such as India will soon catch up with China regarding population. The minimal growth rate is experienced in China since the government wants to limit the population. Religion In the US we have a very diverse base regarding the religion. We have the existence of almost all the major religions of the World. This is the case since 74% are Christians, 10% are Jewish while we have 35 as being Muslim. We also have 1% as Buddhists while other religions such as Hindu account for 1%. Finally, we have a nonreligious population estimated to be 17% of the total population. Comparing this to the prevalent religion in China, over 80% of the population has its allegiance to traditional methods of worship. These traditional forms of worship are accounting for over 80% range from Buddhism, Taoism, and a Folk religion. From the data available around 8% of the population practice a religion which is closely related to Taoism and the Chinese Folk Religion Cultures. Following a distance, second is the Buddhism religion which accounts for about 16% of the total population. In China Christians are estimated to be between 2-4 % of the population while Muslims do not exceed 2% 0n the higher level. We also have a percentage of around 1% whose religion cant be categorized in any of the groups since it is the original tradition religion of China (Van Hermet 2008). Language and Ethnicity In the US most of the inhabitants speak fluent English. This makes English the national language of the country. Over 85% of the total population can communicate in both spoken and written English. Following a distance second is Spanish since we have a large percentage of Hispanic migrants especially from Mexico. Out of the total population, those who speak Spanish are 14%. Chinese speakers in the US are roughly over 2% of the population. Other languages such as Polish, French, Italian, and German are spoken by less than 1% of the total population (United Nations 2017). Further narrowing down to ethnicity, from the 85% who can speak fluent English over 55% of them are Whites. Around 30% are Black Whites, often referred to as Black Americans. We also have Chinese Americans, Spanish Americans, and Italian Americans who account for the remaining 15%. This means that most of the English speakers are Native Americans and a few migrants. This makes US one of the most diverse countries of the World regarding population and language plus ethnicity. In China, the government recognizes over 50 different ethnic groups. Out of these ethnic groups, the Han constitute of 0ver 90% of the total population of the country. The minority groups in China constitute about 10% of the population. Imagine the remaining 49 ethnic groups sharing only 10% of the population? This makes the groups so minor in the ethnic composition of China. Due to this, we are not going to consider the minority ethnic communities in China. From this, we can get the official language of the Country of China. The official language is the Chinese Mandarin. This makes it the official language since over 80% of the Hans ethnic group can speak the language. Secondly, all other tribes in China speak a language which is closely related to Chinese Mandarin, though we have seven different categories of Mandarin Chinese. Pronunciation is almost the same what differs are just a few words. Hence the language is taught as the first language in almost all the schools and children learn it as the first language (National Bureau of Statistics of China 2017). Political Structure of US In the US we have a democratic system of government. This is where the citizens are given the powers to elect their leaders democratically through a national election. This means that we have major political parties in the US which field candidates during elections. This is not a case in China since we have a communist government. A single party only controls the government thus there is no multi-party politics in China. The single party in China is the Communist Party of China. They produce every member who is elected to the various houses of representation found in China. In short, this means that we have no opposition party in China (Yang 2004). Major Diets and their Comparison In the US we have a very modern population which has no limits when it comes to culture and lifestyle. This means that the citizens are at liberty to eat whatever suits their menu and taste. With this, it is not accurate enough to tell the stable food of most of the US citizens. In the US we have a uniformly spread appetite for junk foods. This can be told from the presence of many junk foods outlets in the country such as Subway, MacDonalds. Pizza in etc. From this one can effectively conclude that the staple food for most Americans is junk food which consists of fried foods and beef. This is not a case in China since we have a somehow conservative population. The population is still embedded deeply in its cultures. One can tell this from the foods and drinks which have a Chinese name tag added to them. For instance, you hear people talking about Chinese black tea. This means that most of the population in China has high regards to their traditional foods. This explains why, th ough we have a modern diet in China, it is also largely traditional. Having the traditional background of the diet in China leads us to the staple food of most Chinese. China among the Worlds largest producers of rice. This rice can be manufactured to take different forms which include spaghetti, noodles, pascha, etc. All these have their origin in rice. Further in China rice is eaten using two sticks commonly referred to as chopsticks. Hence chopsticks and rice are synonymous with China. This means that rice is the staple food in China (World Fact Book 2016). Comparing one of the Aspects of Management As we all know, management is a huge topic which has a lot of subtopics. This means that one cant talk of management as a whole since at some point you will deviate from the general purpose of the study. Hence one has to choose a certain sub-topic on management and fully concentrate on it. In our case, I will choose the subtopic on employment legislation in US and China. Comparison between Legislation in US and China In the US we have unique laws and regulations when it comes to employment. These laws and legislation are meant to safeguard the wellbeing of the employees. The government was very much aware that some employers would manipulate their workers. To avoid this, a harmonized guideline on the rights of the workers is contained in the constitution. The workers have gone a step further and formed trade unions to ensure that employers are fully compliant with the legislation. In cases where the employers violate the legislation, they can be sued in a court of law. In the US we have a specific court which deals with labor disputes (Thomas 2008). In China, the legislation on employment is not well outlined in the constitution. This means that no clear guidelines exist on how workers should be treated in the country. This gives room for manipulation of employees. This is the reason why we have very poor working conditions for employees in China since they have no clear basis from where the y can sue their employers. In China cases of employees being molested or harassed by their seniors are common. Employees are also subjected to long working hours. Conclusion From the above discussion and research, we have seen various cultures relating to the US and China. Some of these cultures are common or closely related while are other far apart. This is what leads to the uniqueness of every country. For instance, if you see a person behaving in a certain way or speaking a certain language one can differentiate whether they come from China or the US. For the new entrants to steal these loyal customers away they need to create a product that has a better design, better quality and a more competitive price. Rivalry: Very High Rivalry in the performance apparel industry is very high because each company is creating similar products for performance apparel and shoe apparel. Not only is the product very similar but the prices are very similar and this will create heavy rivalry in the marketplace. 2. SWOT Analysis Strengths: UA has a wide variety of performance apparel products with high quality material and their main focus is how their apparel performs for the user. With Under Armour being sponsors for high school, college and professional level athletes, they have created their image as a strong brand with a high quality product. Weakness: With their product being high quality, it unfortunately comes with a high price. The high prices of UA’s products can cause a decrease in their sales and lose customers to other brands that offer lower prices. Opportunity: UA could apply some strategies to lower prices on their products, which would allow more customers to buy their products. Also, with sports becoming more popular in Europe and Asia, UA could expand their products to those countries. Threats: Being in competition with Nike and Adidas will cause major threats in the performance apparel industry. With the advancement in technology, companies can create new designs or improve their workforce by getting their products out faster than UA. Also, substitute products are easily available on the market, which will also cause major threats to UA. Seven key elements of UA’s strategy: Growth Strategy: UA hopes to achieve $4 billion dollars in sales revenue by 2016, which is two times as much as what was estimated in 2013. UA wants to continue to broaden their product line up to men, woman and even children in a variety of sports. Targeting more consumer segments by widening their distribution channels, more advertising, creating more retail stores and expanding their marketing program. UA wants to be able to penetrate the athletic footwear where Nike has been the leader in the global market. Widening their product sales in foreign countries and becoming a global competitor in the performance apparel industry. Product Line Strategy: UA performance apparel products are designed for hot weather, cold weather and all seasons gear. UA has accomplished this by applying up to date technology and innovation to create their performance apparel products. UA hopes to continue to gain a strong foothold in the footwear market by offering footwear to many sports such as football, baseball, lacrosse, softball, soccer cleats, slides, performance training footwear, running footwear, basketball and hunting boots. Marketing, Promotion, and Brand Management Strategies Budgeting for marketing, promoting, and brand management has increased over time and has helped the company develop to what it is today. The budget has been distributed to the following areas: Sports Marketing, Retail Marketing and Product presentation. Sports Marketing: UA believes that if their product is being worn by high performing athletes and teams on high school, collegiate, and professional levels, then they are promoting their company’s authenticity and also increasing their exposure to potential customers. The way UA has done this is by offering contracts to sport teams and athletes on both the professional level and semi-professional to secure endorsements of rising sport stars. Retail Marketing and Product Presentation: The primary objective of this strategy is to increase floor space of UA products in stores, inform consumers about their products, and creating a more engaging and sales productive way for consumers to shop for their products. UA was able to do this by working with retailers about having their products more visible and also reinforcing the message that UA’s brand was distinct from those of its competitors. Media and Promotion: Just like their competitors, UA uses multimedia and many other promotional outlets to highlight their company and the differences in their products compared to the competitors. Distribution Strategy Wholesale Distribution: During the years of 2011-2012, 70 percent of UA’s net revenues were from selling their products to retailers. There are two big retailers that promoted UA’s products and they are Dick’s Sporting Goods and The Sports Authority. Direct-to-Consumer Sales: This distribution channel includes discounted products through the retailer, at the store and on UA’s website. Management at UA plan to use their website as a growth vehicle for years to come. Product Licensing: 2. 4 percent of UA’s net revenue came from licensing agreements to manufacture and distribute their products. To be able to manufacture and distribute UA’s products, companies have to first be pre-approved by UA and all the products have to be approved by UA’s assurance team before the products can go out into the market. Distribution outside North America: In 2006, UA opened a European headquarters located in Amsterdam to conduct and oversee sales, marketing, and logistics activities across Europe. Product Design and Development UA often upgraded its products as next-generation fabrics became available, which helped design their products with visible technology, utilizing color, texture, and fabrication that would enhance customers’ perception and understanding more about UA products. Sourcing, Manufacturing and Quality Assurance In 2012, more than half of UA fabrics that were used came from five suppliers in China, Malaysia, Mexico, Taiwan, and Vietnam. A majority of the materials that were used to produce UA’s products were petroleum-based synthetics. Since the price and the future of petroleum are highly unstable, UA began changing their fabric materials to cotton-based fabrics, which is more stable in price and supply. UA started outsourcing their manufacturing process in order to reduce cost. About 53 percent of UA’s manufacturing processes are located in Asia, 19 percent are in Central and South America, 18 percent in the Middle East and 8 percent in Mexico. Distribution Facilities and Inventory Management Distribution Facilities: UA’s packaging and shipping process was mostly completed by a third party logistics service provider whose responsibility was to distribute products to foreign markets and a few domestic markets. Inventory Management: UA’s inventory strategy focused on two things to manage the amount of inventory they had on hand. Having sufficient inventory to fill incoming orders promptly Putting strong systems and procedures in place to improve the efficiency with which it managed its inventories of individual products and total inventory. Evaluation of UA’s financial performance UA has seen positive growth each year starting from 2008-2012 on their income statement. Almost every year they have nearly doubled their net income after taxes, which show that they are doing something right in reaching customers with their products. On UA’s quarterly revenue statement we again see that their revenue is increasing every quarter and year. Also, during the third quarter, it looks like UA generates more revenue during the summer months. 5. Strategic issues that Kevin Plank and UA’s management need to address. Also, management actions and recommendations I would advise to UA. The three strategic issues that Kevin Plank and UA’s management need to address are global strategy, distribution problems, and advertisement. First, UA needs to address their global strategy. Global strategy is important because it can help UA increase the amount of revenue it generates in foreign countries. A way for UA to increase their revenue is to study other businesses that are operating successfully in foreign countries. Second, UA has a distribution problem that needs be fixed before it causes more issues. UA needs to try and focus more on their footwear products so they can better compete with Nike and Adidas. Finally, UA needs to focus on providing more advertising. There are very few commercials of UA products being advertised on TV. From the reading, UA only seems to be promoting their products to athletes. There is nothing wrong with this, but what about the people who are not athletes? If you have a celebrity who promotes UA products then non-athlete consumers will go buy those products. My recommendation to Kevin Plank and UA’s management is to continue with successfully running their company, but to focus more on running their business overseas. If UA would allow foreign countries to license their products then those companies overseas can produce those products cheaper and in return gain more revenue for UA. The last thing I would recommend is to invest more money into advertising. The main focus for UA is to promote their products towards athletes, but they should also start focusing on non-athlete consumers.
